I found this document:
Burdick v. United States, 236 U.S. 79 (1915)It seems that for a pardon to be considered, the recipient must accept it.
If the recipient does accept it before conviction or confession, it is considered an admission of guilt.
My question: if a person proclaims innocence and does not accept the pardon thus forcing a trial, can he later accept the pardon if he is found guilty?
Also: Can a pardoned person be compelled to give testimony or face contempt charges?
1. All the recipients accepted the Pardons. (Ie: Nobody turned them down) so the first point is mute...
2. Re: The "Burdick v. United States" case...There is a common misconception that the person getting the pardon "admits guilt"....That is not correct and of course the MEDIA is misleading people again..
If a person receives a pardon, they ONLY LOOK guilty in the court of public opinion....And that's it... So far everyone of those who received the pardons already said "they didn't do anything" but took the pardons anyway..
3. Yes a Pardoned person can be compelled to give testimony before Congress or face contempt charges.....They can also face charges of perjury if they lie to Congress...
But this is another attempt at the MEDIA lying to its audience about the facts of such a scenario.....
All the person has to do is say "I DONT REMEMBER" or I don't Recall 1000 times.
And with PATHETIC/phonies like Comer and Jim Jordan running these hearings, what do you think will happen? ....
The truth is Comer and Jordan had their damn shots to take down a whole bunch of these people big time. And they didn't do shit except run their mouths and WRITE BOOKS (ie: profit off of this)
Yeah Comer the head guy actually wrote a damn book...
All of these people make me sick....We are being run by gangsters...
Re: Preemptive Pardons
This is basically what Biden did.
I believe preemptive pardons should remain invalid because they did NOT specify the crimes for which the people were being pardoned. As far as I know, he only specified time periods and/or generalities.
Here is an example of why logic and the law cannot let that fly: (of course we are not living in a common sense world anymore)
SCENARIO: Based upon rumors and possible evidence, the President thinks someone might be charged for several shoplifting offenses that occured over the last 10 years. He's not sure about them all so he just pardons the person for anything they may have done during that time period.
Several months later it is determined the pardonee is a serial killer who committed 15 heinous homicides, including children, during that time period. The evidence of it is damning. They have it all on video and there are witnesses.
QUESTIONS: Does the serial killer walk because he committed his murders during the time frame for which he was pardoned? Does the pardoning authority have to know about the crimes to issue a pardon for them? If the issuance of a pardon that covers up the pardoning authority's own crimes is it still valid? There are many more questions of great gravity than these.
The ability to issue pardons in such manner as did Joe Biden offers a path to supreme power and Tyranny. It invites profound corruption from the unethical and malevolent. Logic and decency stand in the way of Joe Biden's recent pardons validities.
Btw,
I will bet dollars to donuts that Trump is going to order the release of videos concerning who left that cocaine in the White House....There was video of every damn thing done by every person who EVER entered that building....
If it turns out that the video proves it was Hunters cocaine then because of his Pardon for ANYTHING he may have done over 11 years, he will get away with that too..
